Justice Joyce Abdulmalik of the Federal High Court in Abuja has dismissed a lawsuit seeking the removal of Senator David Mark and former Governor Rauf Aregbesola as the National Chairman and National Secretary of the African Democratic Congress (ADC).

In her ruling on Friday, the judge struck out the case, stating that it concerns the internal affairs of a political party, a matter over which the court does not have jurisdiction.
Justice Abdulmalik explained that membership and leadership within a political party are voluntary, emphasizing that political parties are voluntary associations and cannot compel individuals regarding such matters.

The Judge held that members aggrieved over matters of their parties should always employ internal mechanism to resolve such grievances or at best, opt out and join other parties.
She maintained that cases bordering on party membership and leadership are not justiceable and as such, courts cannot exercise jurisdiction.
