The Supreme Court of Nigeria has overturned the “status quo ante bellum” order issued by the Court of Appeal in the leadership dispute involving the African Democratic Congress (ADC), effectively reaffirming David Mark as the party’s chairman.
The ruling effectively reinstates the executive led by David Mark, reversing its earlier delisting by the Independent National Electoral Commission (INEC).
In a unanimous decision delivered on Thursday, a five-member panel of justices headed by Mohammed Lawal Garba held that the Court of Appeal’s order was unnecessary.
The apex court also ruled that the appeal on jurisdiction was improperly filed, noting that it arose from an ex parte order asking parties to show cause without first securing leave from the appellate court.
