The US Embassy has issued a firm warning to Nigerians regarding visa validity and overstaying visits. The United States clarified that an overseas visitor’s length of stay is determined by a Customs and Border Protection (CBP) officer, rather than the expiration date on their visa.
In a reminder shared on its official X account on Sunday, the Mission explained that CBP officers at the port of entry decide how long a visitor is permitted to remain in the country and not necessarily visa validity.
Under its #VisaWiseTravelSmart campaign, the mission said “Reminder! The length of time an international visitor is allowed to stay in the United States is determined by the Customs and Border Protection (CBP) officer upon your arrival, NOT your visa expiration date.”
The Mission stated that a US visa simply permits a visitor to travel to a United States port of entry and request entry into the country.
Meanwhile, the warning comes as Washington places greater scrutiny on visa overstays by Nigerian nationals. US immigration data and recent policy statements show that Washington is prioritizing nations with higher noncompliance rates, with Nigeria highlighted for closer monitoring.
The Mission had previously issued earlier warnings that remaining past the authorized “Admit Until Date”—even with a valid visa—can lead to immigration violations, revocation of existing visas, and disqualification from obtaining future US visas.
To this effect, the US mission stated that “The CBP officer determines your ‘Admit Until Date’ upon your arrival, and you can check the date upon which you must depart online at http://i94.cbp.dhs.gov,” the Mission added.
Concerns Over Visa Validity and Overstays
American authorities have expressed growing concern in recent years over rising visa overstays globally. Data from the U.S. Department of Homeland Security indicates that Nigeria records among the highest overstay rates across visitor and student visa categories.
Official figures reveal a 5.56 percent overstay rate for Nigerian B-1/B-2 visitor visas, alongside an 11.9 percent rate for student and exchange visitor visas (F, M, and J classifications).
In response, the U.S. Mission in Nigeria has expanded its #VisaWiseTravelSmart public awareness initiative to guide applicants through visa requirements, interview preparation, and compliance following travel.
Officials have firmly warned that U.S. visa overstays not only affects the individual traveller but also has gross potential of leading to stricter visa requirements for other Nigerians, including longer processing times and additional documentation.
Additionally, U.S. Mission urged the thousands of Nigerians who apply regularly for student, business, and tourist visas to check their I-94 records immediately after arriving in the United States and leave before their authorised stay expires to protect their travel history.

Meanwhile, this comes less than twenty four hours after the US mission reminded Americans with dual nationality that they must enter or leave the country with a valid US passport.
In an advisory posted on its official X account on Sunday, the embassy stated that the need applies to all United States citizens, including minors, who have citizenship in another country.
The embassy warned that dual US nationals cannot apply for the Electronic System for Travel Authorisation (ESTA) using their foreign passports.
