ADC: Supreme Court Ruling Sparks Caution as SAN Maduabuchi Warns Against Premature Celebration

Senior Advocate of Nigeria, Oba Maduabuchi, has said the Supreme Court’s ruling on the African Democratic Congress (ADC) is not something to celebrate.

Speaking during an interview on Arise Television’s Morning Show, Maduabuchi insisted that the decision on ADC does not settle the matter.

He was reacting to the April 30 judgment of the apex court, which nullified the Court of Appeal’s order that had prevented the recognition of David Mark as the National Chairman of the ADC.

According to reports, the Supreme Court, in a unanimous decision delivered by Justice Mohammed Lawal Garba, ruled that the Court of Appeal erred by issuing an order that was not requested by any of the parties involved.

Expressing his view, Maduabuchi said, “The ADC had no basis for approaching the Supreme Court, as there was no appealable ruling from the Federal High Court.

“The Court of Appeal exceeded its jurisdiction by granting an order that was never sought. While it rightly noted that there was no valid appeal from the David Mark faction, it went further to direct that the status quo be maintained.

“That decision was flawed. When INEC acted on the Court of Appeal’s directive and removed David Mark, it did so on legitimate grounds. The order was to maintain the status quo ante bellum, not the status quo,” he explained.
