Lagos based socialite sues police over alleged N50m over harassment

Gail Fajembola, a Lagos based socialite, has filed a fundamental rights enforcement suit in the Federal High Court in Lagos, requesting judicial intervention over her claims that the Nigeria Police Force has been orchestrating ongoing threats, harassment, and intimidation on behalf of private individuals.

In the case filed by her lawyer, Akin Apara of BA LAW LLP, and designated FHC/L/CS/2025, the applicant is requesting court ruling over the fact that the police do not have the legal right to get involved in a purely civil dispute over possession of a flat, Flat K9-2, Ocean Parade Towers, Banana Island, Ikoyi, Lagos.

According to information gathered, Ogbonna Nweke, Olutoyl Estate Development & Services Ltd., businessman Tunde Ayeni, the Inspector General of Police, the Assistant Inspector General of Police (Zone 2), and the Commissioner of Police (Lagos State Command) are the respondents in this case.

Fajembola has urged the court to  rule that “any attempt or threat by the police to arrest, detain, or otherwise interfere with my liberty or dignity on account of a private civil disagreement is unconstitutional, unlawful, and an abuse of police powers”

Additionally, in accordance with Sections 35(1), 36, 41(1), and 46(1) of the 1999 Constitution (as amended), she has requested a perpetual injunction to prevent the first through fourth respondents (the police authorities) from further interfering with her constitutionally guaranteed rights to freedom of movement, personal liberty, and human dignity.

For what she describes as “unlawful and unconstitutional interference with my rights through threats, harassment, and police intimidation,” she also requested that the court grant N50 million in damages.

Olawale Arowosaye, a litigation clerk at BA LAW LLP, deposed to the court in a 10-paragraph affidavit supporting the originating motion, stating that the conflict stemmed from a soured personal relationship between the applicant and Mr. Tunde Ayeni, the sixth respondent.

The affidavit states that “Mr. Ayeni permitted the applicant to move into the flat in 2016.” She furnished it with $45,792 of her own money and stayed there till moving to the UK in 2019.

The flat was briefly rented out as an Airbnb after she moved, and in 2022 it was leased to Expand Global Industries Ltd. for a year.

The applicant argues that the sixth respondent gave their verbal and full approval for the lease to be executed.

However, following the severance of their relationship soured, the applicant claims that Ayeni and Olutoyl Estate Development & Services Ltd. started pressuring her to give up the property and remove the renter.

She further stated that after being called to their headquarters by the Nigeria Police Force, she and other individuals were allegedly harassed and intimidated.
