“Nnamdi Kanu: I Want My Case in Southeast, Not Elsewhere”

The leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, reaffirmed on Wednesday that Justice Binta Nyako of the Abuja Federal High Court should not preside over his case.

Kanu instructed his lawyers to ensure Justice Nyako remains excluded from the proceedings following her prior recusal.

On September 24, 2024, Kanu urged Justice Nyako to withdraw from his trial, citing a loss of confidence.

In response to this request, the trial judge stepped aside from Kanu’s case and passed the case file to the Chief Judge of the Federal High Court, John Tsoho.

Nonetheless, during a regular meeting with his legal team, led by lead counsel Aloy Ejimakor, at the Department of State Services (DSS) facility in Abuja, Kanu expressed that Justice Nyako would violate her own ruling if the case were to resume under her supervision.

This information was disclosed in a statement from Ejimakor on Wednesday.

The statement indicated that Kanu’s case should be moved to the Southeast if no judge in Abuja is willing to handle it.

Ejimakor mentioned, “The routine visits to Onyendu Mazi Nnamdi Kanu remain consistent as the legal team just wrapped up a significant visit today.”

“The main topic addressed during this visit was the approaching court date for the continuation of MNK’s trial.

“Due to its constitutional significance, Onyendu directed the legal team to take urgent actions to prevent his case from being overseen by the same Justice Binta Murtala-Nyako, who had exited the case due to the recusal order issued on September 24, 2024.”

“The concern was emphasized that if the case remains with Justice Murtala-Nyako, it would imply that the same court is disregarding its own ruling.”

“We are therefore eager to proceed to court as long as a different judge from the Federal High Court is assigned to the case.”

“If no other judge in Abuja is willing to take on the case, the Chief Judge is welcome to transfer it to Umuahia, Awka, Enugu, Asaba, Port Harcourt, or any other Federal High Court within the former Eastern Nigeria where the alleged offenses occurred or had an impact.”
