Why Most Tax Disputes Start at the State Level

Nigeria’s newly established tax referee is shedding light on where small businesses and taxpayers face their biggest challenges. Speaking at a media briefing in Lagos, Dr. John Nwabueze, Chief Executive of the Office of the Tax Ombud, revealed that most reported grievances involve state internal revenue agencies.

While the agency has handled over 20 genuine dispute cases since beginning full operations, officials emphasize that lack of public awareness keeps many citizens from seeking free help.

The Backstory: Creating a Free Tax Dispute Mechanism

To understand why this new agency exists, we must look at how tax disagreements were previously handled across the country.

Historically, when entrepreneurs faced unfair tax assessments or overlapping levies, they had two options: pay the demands or face expensive court battles. To fix this gap, the federal government enacted the Tax Ombud Act, officially launching the independent agency on January 1, 2026. Designed as an impartial mediator, the office resolves disputes between taxpayers and revenue authorities at no cost. Consequently, citizens can now challenge questionable tax demands without incurring legal fees or waiting years for court verdicts.

Speeding Up Resolutions and Improving Public Access

Despite handling a modest number of cases so far, the agency maintains a strict timeline for resolving taxpayer grievances.

Out of the 20 verified cases received, the tax ombud successfully resolved eight disputes within its statutory 14-day limit. Meanwhile, twelve remaining cases are actively undergoing investigation. Data shows that twelve complaints arrived through the agency’s online portal, two via email, and six through its call center. Dr. John Nwabueze noted that revenue authorities have provided full cooperation during inquiries, allowing disputes to settle smoothly without disrupting legitimate revenue collection.

Real Examples and Regional Expansion Plans

Real-world experiences highlight how arbitrary state assessments burden growing enterprises and everyday citizens.

For instance, consider a regional logistics company receiving duplicate road levies from multiple state task forces. In the past, such businesses had little choice but to comply or risk vehicle seizure. Today, taxpayers can submit complaints online or call toll-free lines in major local languages. Furthermore, the agency is expanding its physical presence across Nigeria’s six geopolitical zones to reach rural communities. Nigeria now stands as the eighth African nation to implement an independent tax ombud framework, joining global efforts to build trust in public revenue systems.

Original Insights on Reforming Local Tax Enforcement

Fixing tax disputes long term requires moving beyond individual complaint resolution to systemic reform across all government tiers.

First, state revenue boards must harmonize local levies to prevent informal task forces from harassing transport workers and small shops. Additionally, increasing media campaign efforts will inform more traders that dispute resolution services are entirely free. When small business owners know their rights are protected, voluntary tax compliance increases naturally. Therefore, strengthening institutional mediation remains essential to protecting small-business capital and fostering equitable economic growth across Nigeria.
