2027: Innocent Ojike Drags APGA, INEC to Court Over Primary Election Result

An aspirant of the All Progressives Grand Alliance (APGA), Innocent Ojike, has approached the court to challenge the outcome of the party’s primary election for the Oyi State Constituency seat ahead of the 2027 general election.

Innocent Ojike, who currently represents Oyi Constituency in the Anambra State House of Assembly, is contesting the declaration of Kosisochukwu Ibemesi as the winner of the primary election held on May 23, 2026.

In a suit filed at the Federal High Court in Awka and marked FHC/AWK/CS/173/2026, and filed through his counsel, Reuben Atabo (SAN), APGA, Ibemesi, and the Independent National Electoral Commission (INEC) were listed as defendants.

Court documents dated June 4 show that Ojike claimed he secured the highest number of valid votes in the exercise, polling 3,524 votes. He also stated that he was duly announced as winner by what he described as the authorised returning officer, Dr Nnewaluem James.

He maintained that he remains the legitimate candidate of APGA for the Oyi State Constituency election, relying on Section 84(1) of the Electoral Act, 2026.

Among his 12 prayers before the court, Ojike is seeking the nullification of APGA’s declaration of Ibemesi as the winner of the primary held on May 25, 2026.

He is also asking the court to compel APGA to submit his name to INEC as the party’s candidate for the 2027 general election, and to direct INEC to accept and recognise his candidature.

In addition, Ojike is demanding N100 million in exemplary damages against APGA and Ibemesi.

The court has yet to fix a date for the hearing of the case.
