The appeal court sitting in Lagos has nullified the rape conviction against the Medical Director of Optimal Cancer Care Foundation, Dr Olufemi Olaleye.

The court of appeal in Lagos has voided the conviction against the director of Optimal Cancer Care Foundation Dr Olaleye Olufemi.

Olufemi was convicted and a judgement passed for life imprisonment by the High Court on a two-count charge of sexual assault and defilement by penetration of his wife 16 years old niece.

The court in a judgment delivered it on friday. Dr Olufemi appeal and acquitted him of the charges. There was three -member panel of the appeal court are Bada Olukayode, Sirajo Mohammed and Ojo Folasade.

The judgment read by Bada which was adopted by the two other justices. The court of appeal held that the lower court made a mistake based on the tainted and unrelaiable evidence of Oluremi, the defendants wife and the alleged survivor.

Appeal court stated that Olufemi’s conduct showed that she was was really motivated by high level of greed to posses the appellant’s assest upon his incarceration. The appellate court describe Olaleye’s wife as a Olaleye’s wife as a baised witness.

The court also ruled that the the lower court relied on the unverified information evidence of the other witnesses on the age of the alleged. The court ruled that the prosecution’s case that the alleged survivor a 16 years old was bereft of evidence.

There a forensic specialist, of a medical specialist, from Mirabel Centre, and the investigating officer’s as worthless.
