A report by the Information Commissioner’s Office (ICO) criticized the Commission for not implementing basic security measures, like patching known vulnerabilities, which could have prevented the breach. The hack, which began in August 2021, was attributed to China, although China denied involvement. Despite the severity of the incident, the ICO did not fine the Electoral Commission, citing the lack of evidence that the stolen data was misused and the limited nature of the data involved. The ICO’s decision aligns with a current policy to avoid large fines for public sector bodies. The Commission has since taken steps to improve security, including updating infrastructure and implementing better password controls.
